UPS REPORTED MY DEVICE AS MISSING

I ordered a new phone through T-Mobile and they shipped the device with UPS. After a few days of waiting UPS claimed that the device was out for delivery but then 2 days later they reported the device as missing. I called to speak with a T-Mobile representative and told them that the device was reported as missing according to UPS. They have said numerous times that they initiated a handset research report to try to wait for the device to be sent back from UPS. I do not understand why they don’t understand that the device is quote on quote missing and it won’t be sent to the T-Mobile warehouse because someone at UPS most likely stole the device. They will not issue me a refund until the handset research report shows that the device has been sent back.. This is truly since UPS is the one that lost device. It has been 3 weeks and TMobile still hasn’t received the device which means no refund for me. I am considering leaving this company and going to AT&T every time I have an issue with this company it takes so long to be resolved and if I don’t stay on top of the issue and be persistent then nothing will get handled.
